ADVANT Beiten Publishes Brochure on Artificial Intelligence Law
In early 2021, ADVANT Beiten published the first edition of the brochure “Law of Artificial Intelligence.” They were certain: Artificial intelligence is one of the major issues of the future for our society and economy—and is therefore also highly relevant from a legal perspective.
The rapid pace of developments, especially in recent months, has nevertheless come as a surprise. There is hardly a media outlet that hasn’t reported on it in one way or another—and schools are testing the latest possibilities just as much as companies are.
With this brochure, ADVANT Beiten aims to provide a concise overview of the current legal situation and the state of the debate. A brief overview such as this cannot claim to be exhaustive in either scope or depth.
In addition, they venture a look ahead at future developments and possible adjustments to the legal framework in light of the increasing autonomy of AI and robotic systems. Particularly intriguing are questions regarding the protectability of works created by AI on the one hand, and liability issues on the other—extending to the not-so-provocative question of whether artificial intelligence should be the holder of rights, or perhaps even be granted legal personality. Here, too, given the limited scope of this work, the aim is merely to provide food for thought and stimulate discussion.
The work is largely based on the status as of June 2023.
For the sake of clarity, the term “artificial intelligence” (AI) will be used hereinafter as an umbrella term encompassing (intelligent) robots as well as autonomous and/or self-learning systems, generative AI, computer programs, and applications.
